SCHNEPP, J.

Plaintiff, Edward M. Joseph, brought this action to obtain a determination of his rights and benefits under the terms of the New York State Teamsters Conference Pension and Retirement Fund ("plan”) which became effective January 1, 1954.

The plan, established pursuant to collective bargaining agreements reached between a number of local unions of the International Brotherhood of Teamsters and employers in the trucking and allied industries participating in the plan, is designed to provide pensions for employees represented by any of the local unions and employed…
