delivered the opinion of the court:

After a bench trial Sammie Garrett (hereinafter defendant) was found guilty of the murder of Karen Thompson by shooting her with a shotgun and for the unlawful use of a weapon. After denying defendant’s motion for a new trial, the court imposed a sentence of 20 to 40 years on the murder charge and a concurrent sentence of 1 to 5 years on the unlawful use of weapons charge.

Thereafter, the defendant filed a direct appeal (No. 55230) urging that the defendant was not proven guilty of the offense of murder beyond a reasonable doubt…
