Defendant, Gene Lovitz, appeals from an order of the circuit court of Du Page County which dismissed his petition filed under the Post-Conviction Hearing Act (Ill. Rev. Stat. 1979, ch. 38, par. 122 — 1 et seq.) without an evidentiary hearing. After a jury trial in April 1974, defendant was convicted of the murder of his wife, Donna Lovitz, and was sentenced to a term of 14 to 45 years’ imprisonment.
