The defendant was convicted by a jury of operating an automobile while under the influence of intoxicating liquor on Route 17 in the town of Fayston, Vermont, on March 5,1972.

At the close of the State’s evidence defendant moved for a directed verdict in his favor and for a dismissal of the case. This motion was denied. Following the jury’s verdict of guilty, the defendant further moved to set aside the verdict and for judgment in his favor notwithstanding the verdict. This motion was also denied.
