Both EchoStar Satellite Corporation (“EchoStar”) (Docket No. 99-1761) and Columbia Communications Corporation (“Columbia”) (Docket No. 99-1835) appeal various rulings of the district court which found EchoStar liable for breach of contract after a jury trial. Oral argument was heard by the Court on April 3, 2000. * After the appeal was filed and briefing began, EchoStar filed a motion in the district court pursuant to Fed.R.Civ.P. 60(b)(3) requesting a new trial based on alleged discovery misconduct by Columbia.
