On the 22d day of February, 1908, in the city of Columbia, the defendant, Wade H. Sellers, shot to death James P. Farmer. The plaintiff, May W. Farmer, the widow of James P. Farmer, having administered on his estate, recovered a judgment of $5,000 for the benefit of herself and his children against the defendant under the allegation that the homicide was committed “unlawfully, wilfully, wantonly, recklessly and maliciously.” The defenses set up in the answer were: First, a general denial; second, that the defendant shot Farmer in the…
