BOREMAN, Circuit Judge;

Appellant, William Ralph, was convicted of rape and sentenced to death by three judges of the Circuit Court of Montgomery County, Maryland, sitting ■ without a jury. ' His conviction was affirmed by the Maryland Court of Appeals 1 and the United States Supreme Court denied certiorari. 2 Ralph then filed in the United States District Court for the District of Maryland a petition for a writ of habeas corpus. The District Court entered an order staying further proceedings on the petition and granted a stay of execution to permit Ralph to exhaust state remedies by pursuing…
