This matter is before the undersigned on defendant Elborne Mitchell’s motion to dismiss for lack of personal jurisdiction pursuant to Fed.R.Civ.P. 12(b)(2) and for failure to state a claim pursuant 'to Fed.R.Civ.P. 12(b)(6). Finding insufficient contacts by defendant with North Carolina or the United States as a whole, the court holds that it may not assert personal jurisdiction over defendant Elborne' Mitchell under either the North Carolina long-arm statute or the relevant federal statutes providing for nationwide service of process.
