Defendant, Ed Baker, was charged by information filed in the district court of Muskogee county with the crime of “larceny from a boxcar”; was tried, convicted and sentenced to serve a term of six months in the penitentiary, and has appealed.
The only contention of defendant for reversal of this case is that he was' not guilty of any criminal intent, and that therefore the verdict and judgment and sentence is contrary to the law and the evidence.
