This cause comes here for review on exceptions by the county attorney to an order of the district court sustaining a demurrer interposed by the defendant to an indictment returned against him by the grand jury charging him with the offense of malfeasance in office. The defendant, Loechner, was a member of the board of education of the school district of South Omaha, Douglas county, Nebraska.
