The appellants, wbo are plaintiffs, sued in assumpsit upon tbe common counts, to recover for services as attorneys, claimed to liave been rendered at tbe instance and request of defendant. Tbe plaintiffs’ right of action grew out of a bill filed in tbe Chancery Court, in which E. C. Gordon was complainant, v. Bean & Williams, filed to enforce specific performance of an agreement between Bean & Williams in regard to tbe sale of twenty acres of land.
