Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered August 1, 2006, which denied defendant’s motion for resentencing pursuant to the Drug Law Reform Act of 2005.

In 1989, defendant pleaded guilty to one count of criminal possession of a controlled substance in the second degree—a class A-II felony—and was sentenced to a term of imprisonment of six years to life. Defendant was released on parole on this conviction in 1994 but was later returned to prison upon his plea of guilty to one count of attempted assault in the second degree.
