We take the following statement, showing the nature and result of this suit from the brief of appellant, which is conceded by appellee to be correct.
“This suit was instituted by appellee, Jack Roberts, by his next friend, Zemeriah Roberts, against appellant, St. Louis Southwestern Railway Company of Texas, in the district court of Angelina county, to recover damages for personal injuries received by him while a laborer in its section gang; said injuries having been occasioned by the alleged negligence of appellant in permitting a hand car upon which appellee was riding to…
