Boston Safe Deposit and Trust Company (Boston Safe), as trustee under the will of Nellie Parney Carter and executor of the will of Stella Cheremeteff, commenced this action in the Probate Court for Suffolk County seeking instructions about the distribution of the balance of the trust. The defendants Semplicio Paris and Union de Banques Suisses (UBS) answered, each claiming this balance. By counterclaim UBS sought damages against Boston Safe for its having wrongfully made certain prior distributions to Paris. By cross claim UBS sued Paris upon debts owed by him.
