S. Bobinson as owner entered into a contract with W. A. Lewis for the construction of a building. Williams & Guerry sold and delivered to Lewis materials of the value of $3693.74, which were used in the construction of the building, and in due time filed a materialman’s lien against the real estate. The legal title to the property was in E. Bobinson, the father of S. Bobinson, on whose authority the building was constructed.
