Action in tbe district court for Hennepin county to recover $25,-500 for personal injury received while a passenger upon one of defendant’s street cars. The answer set up a former action between the parties upon the same cause of action wherein judgment was duly docketed, upon the merits thereof, against the plaintiff in this action in the sum of $11 and in favor of defendant. The case was tried before Hale, J., who made findings and ordered judgment dismissing the action.

Plaintiff was a passenger upon one of defendant’s street cars and ■while alighting therefrom fell and was injured.,/ She brought an ^.action against defendant for damages, in which she charged that •defendant caused the accident hy suddenly and negligently closing the gates and starting the car while she was in the act of alighting. After a trial lasting several days the jury returned a verdict for •defendant, and thereafter judgment was duly entered thereon in favor of defendant.
