This is an appeal by Gus J. G-rubczak, the plaintiff, from a judgment in favor of the Chicago Railways Company, the defendant, in an action brought by the plaintiff to recover damages for personal injuries alleged to have been caused by the negligence of the defendant.

The case was tried before the court and a jury. At the close of the plaintiff’s evidence, on motion of the defendant, the court peremptorily instructed the jury to return a verdict in favor of the defendant.
