The respondent warden of the Connecticut state prison appeals from the judgment of the habeas court granting the habeas corpus petition, vacating the conviction and ordering a new trial. The habeas court found that the failure of trial counsel to present the testimony of the physician who treated the petitioner for injuries received prior to the date of the crime denied the petitioner the effective assistance of counsel.
