The dispositive issue in this habeas corpus appeal is whether the petitioner, John M. Phillips, was denied his right to the effective assistance of counsel under the sixth amendment to the United States constitution1 because an actual conflict of interest adversely *114affected his lawyer’s performance. In 1983, the petitioner was convicted, after a jury trial, of sexual assault in the first degree in violation of General Statutes § 53a-70, unlawful restraint in the first degree in violation of General Statutes § 53a-95, and burglary in the first degree in violation of General Statutes § 53a-101.…
