FOURNET, Chief Justice.

This is a suit by a landowner to have decreed extinguished, for non-use of ten years, a certain mineral servitude affecting his-property executed on January 15, -1937; and from an adverse judgment, he prosecutes this appeal.

According to an agreed statement of facts the plaintiff, P. F. Childs, owner of an 80 acre tract of land in Webster Parish — the N/2 of the SW/4, Section 8, T. 21 N., R. 9 W. — on January 15, -1937, sold to C. P. Talbot, B. V. Bentley and O. V.
