Plaintiff R.V.S., L.L.C. (“RVS”) filed suit against the City of Rockford (“Rockford”) seeking a temporary restraining order and to preliminarily and permanently enjoin Rockford from enforcing an ordinance regulating “Exotic Dancing Nightclubs.” Rockford Ordinance 2002-308-0 (“the Ordinance”) prohibits the operation of those businesses within 1000 feet of churches, schools, residences and other Exotic Dancing Nightclubs, and in addition, requires the issuance of a special use permit before such businesses may operate in nonproscribed locations.
