W. J. and W. S. Springer filed suit in the district court of Denton county against the Texas Pacific Railway Company, W. E. Callahan Construction Company, and the city of Dallas, for damages. Plaintiffs alleged that the Texas Pacific Railway Company, hereinafter called railway company, has a local agent in Denton county, and that W. E.
