Christine Ness appeals from a district court 2 order granting summary judgment, which affirmed a decision by the Secretary of Health and Human Services (Secretary) to limit Ness’ social security disability benefits to a closed period from October 4, 1985, through May 1, 1987. Ness argues that the Secretary’s decision to so limit her benefits should be reversed because it is not supported by substantial evidence on the record as a whole.
