Appeal from Vernon Circuit Court. — lion. H. G. Timmonds, Judge. (1) The demurrer to the evidence should have been sustained because there was no evidence offered tending to show that plaintiff complied with the conditions of the reward, and because it was affirmatively shown that the service rendered hy plaintiff in making the arrest was rendered prior to the reward being offered by Vernon county. Smith on the 14th day of July, 1901, was a member of the police force of Council Bluffs, Iowa, and there is evidence indicating that he was also at the time engaged in the detective business along lines not covered by his official duties as such policeman.
