The appellants, Earl J. Reynolds and Anna Reynolds, appeal the July 1, 2009 order of .the Circuit Court of Monroe County that granted summary judgment to the appellee, Jerry I. Hoke, Sr., in the appellants’ action to set aside a tax deed that vested title to the subject real property in the appellee. For the reasons set forth below, this Court finds the circuit court’s ruling to be in error. Accordingly, we reverse the circuit court’s order and we remand for proceedings consistent with this opinion.
