MEMORANDUM AND ORDER

GESELL, District Judge.

Nine different organizations1 have brought this action for declaratory judgment and permanent injunction claiming that Executive Order 11605 and the so-called Attorney General’s List, which is given further vigor thereunder, are unconstitutional. The Attorney General and defendant members of the Subversive Activities Control Board answered, denying all material allegations of the complaint and thereafter moved to dismiss.
