Accused was tried by general court-martial for premeditated murder, and convicted of unpremeditated murder, in violation of Article 118 of the Uniform Code of Military Justice, 10 USC § 918. The facts, insofar as pertinent to this appeal, are as follows: Accused shot to death another serviceman following an altercation involving the obligation of accused’s wife, a barroom waitress, to accept payment in foreign specie from the deceased.
