Condemnation proceedings. The plaintiff having appealed from, the award of the commissioners to the district court for Hennepin county, a trial was had in the district court for Anoka county, before Koon, J., and a jury, and plaintiff had a verdict for $13,800. Defendant appeals from an order refusing a new trial.

The land appropriated by the railway company in these proceedings is one entire lot belonging to plaintiff, in the city of Minneapolis, and lying adjacent to the right of way and depot grounds of the company in the city. The only question is the amount of plaintiff’s damages, being in this instance the value of the lot in controversy. It is admitted that the company owned the land adjoining on the south, east, and west, the lot being 160 feet in length by 50 feet in width.
