This matter comes before the Court for a decision on the merits following a bench *968trial. This case is a wrongful death action under the Federal Tort Claims Act (“FTCA”) filed by plaintiff, Janella Knierim (“Mrs. Knierim”), Personal Representative of the Estate of Patrick Joseph Knierim (“Mr. Knierim”), against defendant, United States Government Department of the Navy (“Navy”).
