EISMANN, Justice.

This is an appeal out of Ada County from an appellate decision of the district court upholding action taken by the Idaho State Board of Medicine against the appellant physician. We reverse the decision of the district court.

Factual Background.

Robert M. Mena was licensed to practice medicine and surgery in Idaho on September 13, 2003. In 2007, staff members at the hospital in Jerome where he had privileges reported behaviors that suggested to them that Dr. Mena may be abusing drugs or alcohol.
