This case is before us on Certificate for Review by the Judge Advocate General of the Navy in accordance with Article 67 (b) (2) of the Uniform Code of Military Justice (Act of May 5, 1950, 64 Stat 108; 50 U.S.C. §§ 551-736). Accused was tried under UCMJ on June 26, 1951, by special court-martial on two separate charges of absence without leave.
