Error to the Court of Civil Appeals for the Third District, in an appeal from Travis County. Mrs. Seiders .sued the insurance company and the latter had judgment in the trial court canceling the policy sued on upon return of the premium paid. Plaintiff appealed, and on affirmance of the judgment obtained a writ of error.

BROWN, Associate Justice.

The plaintiff sued the defendant upon a policy of life insurance upon the life of her husband, - P. W. Seiders, for the sum of $3000. The defendant pleaded, among other things, that the deceased, in his application for insurance, represented and warranted that he had never made application for insurance to any other company which had been rejected, and that the said representations were false in fact.
