OPINION

MEEHAN, J.S.C.

This matter is before the court on a summary dispossess action pursuant to N.J.S.A. 2A:18-53 et seq. The plaintiff contends that N.J.S.A. 2A:18-61 et seq. does not apply to his premises as they are owner occupied with two rental units. • The plaintiff is the owner of premises that has three residential units and a tavern on the premises. Plaintiff owns and operates the tavern and lives in one of the residential units. The defendant has been a tenant on the second floor for a number of years going back to before plaintiff purchased the premises.
