This was an action of assumpsit brought in the court of common pleas of Clearfield county to recover a balance of purchase money alleged to be due on a written contract for the sale of certain coal properties situated in that county. The defendant is a citizen of New York, but it is alleged by the plaintiffs that, at the time of the institution of this suit, he was engaged in business in Clearfield county, and had an agent in that county.
