Appellants Jeffrey Lui, David Lui and Fantasia Restaurant & Lounge, Inc. appeal from the District Court’s summary judgment in favor of Appellees based on the abstention doctrine announced in Younger v. Harris, 401 U.S. 37, 91 S.Ct. 746, 27 L.Ed.2d 669 (1971). After Lui 1 filed the instant appeal, the Delaware Superior Court rejected on the merits Lui’s motion to dismiss the criminal prosecution pending against him, which arose out of Lui’s failure to obtain an adult entertainment establishment license.
