Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.
After confidential information was received by the Inspector General’s office that petitioner was conspiring to smuggle drugs into the correctional facility in which he was incarcerated, petitioner’s telephone calls were monitored and recorded.
