Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Clinton County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner, a prison inmate, was charged in a misbehavior report with, among other things, drug possession, smuggling and a facility visitation violation after an investigation suggested that he made arrangements by telephone to have drugs *1348delivered to the facility. After a tier III disciplinary hearing, petitioner was found guilty of the listed charges.…
