The plaintiff obtained judgment against the defendant at the Spring Term of 188-3 of the Superior Court of the county of Hertford, and the defendant appealed to this court.

At the February term of 1884 of this court, the appellee in that- appeal moved to dismiss the same upon the ground that the undertaking upon appeal had not been justified. The motion was allowed and the appeal dismissed.

Tins is an application for the writ of oertiorari to bring up the ease and have it heard as upon the appeal thus dismissed. Granting that there was reasonable cause for the appeal, lost as above indicated,…
