(After stating the foregoing facts.) As disclosed by the record, the motion for new trial was filed within 30 days and during the term at which the trial was had.

The bill of exceptions recites that the “case proceeded to verdict and judgment [on January 24, 1946] in favor of the plaintiffs, at the December Term 1945.” January is in the December Term. (See Ga. L. 1946, p. 797).
