1Opinion of the Court

WHEELER, District Judge.

This bill is brought for an alleged infringement of design patent No. 7,456, issued May 26th, 1S74, for a design for stoves called the “Argand.”

The defences are: want of novelty in the invention patented; that the patent is void because it claims too much; and denial of infringement.

The statute provides, among other things, that any person who by his own industry, genius, efforts and expense, has invented and produced any new and original design for a manufacture, or ornament to be cast on any article of manufacture, the same not having been known or used by others…
