delivered the opinion of the Court.
The defendant, Sam Bradam, was convicted of involuntary manslaughter for the unlawful killing of J. C. Smith as a result of the collision of an automobile and a truck on the Cleveland-Duektown highway a short distance east of the town of Cleveland. The tragedy occurred about 8:30 p. m. in March, 1949. The automobile which deceased was driving approached and struck the truck from the rear. The proof shows that the truck had no lights and that the deceased was driving at approximately fifty miles an hour. The record further reveals that…
