Plaintiff in error and one Lizzie Dazey were jointly indicted in the circuit court of Shelby county for arson, the specifications being that they willfully and maliciously burned or caused to be burned a certain dwelling house in the village of Findlay, the property of Lizzie Dazey, one of the accused. Plaintiff in error was awarded a separate trial and on trial was found guilty.
