James Hudson and Frank Switzer were indicted jointly at the October term, 1929, of the circuit court of Douglas county for the crime of arson of a dwelling house on September 30, 1929, in the city of Areola, Douglas county. Hudson was granted a separate trial before a jury, and his co-defendant, Switzer, was the principal witness who testified against him. The jury returned a verdict on January Ti, 1930, finding Hudson guilty as charged in the indictment and his age to be sixty-one years. Motions for a new trial and in arrest of judgment were overruled by the court and judgment was entered…
