Before the court are the defendants’ respective motions for summary judgment. The motions are ripe for disposition.
BACKGROUND
Plaintiff Jose Luis Urena Berdejo (“Berdejo”) is an unauthorized illegal alien who worked for a company named, alternatively, Ideal Systems, Inc., Ideal Systems Constructions, Inc., or Ideal Systems USA, Inc. (“Ideal”). (Def.’s Statement of Material Facts (“SMF”) ¶¶ 2, 9 (Doc. 62)).
