delivered tbe opinion of tbe Court.

This was an application by tbe State to the Court below, for a mandamus to tbe eounty Court of Crittenden county.

The questions presented are of grave importance, involving, as they do, the taxing power of the State and the constitutionality of her legislation.

The record shows that a part of the swamp and overflowed lands granted to the State by act of Congress, approved 28th September, 1850, lie in Crittenden county; that pursuant to the provisions of an act of the Legislature, passed 11th January, 1855, the tax assessor of…
