On tbe 15th day of February, 1893, tbe respondent entered into a contract with tbe city of Port Townsend, a municipal corporation, created and existing under an act of tbe legislative assembly of tbe territory of Washington, for tbe lighting of tbe streets of said city with electric lights for tbe period of five years. The payments were made according to contract for two years,since which time no payments have been made, and this *408action was brought to enforce the same.
