This matter is before the court on defendant Richard Kasak’s (defendant) and defendants Rudolph and Helen Kasak’s motion for judgment on the pleadings. The procedural history of this case is as follows: plaintiff, The Estate of Jeffrey Carvalho (deceased minor), by and through his parents, Michael Carvalho and Cynthia Carvalho, commenced this action by complaint filed February 20,2004.
