Appeal from a judgment of the Supreme Court (Lomanto, J.), entered November 22, 1993 in Fulton County, upon a decision of the court in favor of plaintiffs.

The parties entered into an agreement whereby plaintiff A-l General Contracting, Inc. (hereinafter plaintiff) was to demolish a former meat packing plant in the City of Utica, Oneida County, which consisted of an abandoned structure and a large smokestack.
