Raymond, Judge:
In September, 1949, the plaintiff, Kap-Tex, Inc., instituted this action of detinue in the Circuit Court of Mercer County, to recover from the defendants, Lacy Romans and Paul C. Trilli, partners trading as Bluefield Sportswear, the possession of certain articles of personal property consisting of sewing machines and attachable equipment of the alleged value of $2,500.00 delivered to the defendants in May of that year.
