This ease involves an automatic appeal from a death penalty. Charged with one count of conspiracy to commit robbery, five counts of robbery and one count of first degree murder, defendant, after a jury trial, was found guilty of all those offenses. The jury rendered a verdict for the death penalty on the murder count. On appeal (People v. Terry (1962) 57 Cal.2d 538 [21 Cal.Rptr. 185,370 P.2d 985]) this court affirmed the judgment excepting the determination of the penalty on the murder count.
